The following are the Terms and Conditions for rental of Wifly Travel Wifi. In order to place an order with our company, you must read and agree to the terms and conditions (“Terms and Conditions”) below. It is your responsibility to read and understand the terms and conditions completely and thoroughly, so please do not hesitate to contact us if you have any questions.
WIFLY PHILIPPINES and you (the “Customer”) hereby agree to the following terms and conditions with respect to the product by WIFLY PHILIPPINES to the Customer of the wireless communication device and peripheral equipment (the “Equipment”), including, but not limited to, mobile WiFi hotspot terminal, USB cables, User Manuals, and mobile data services (the “Services”) which are described herein or included in any written agreement between Customer and WIFLY PHILIPPINES for products and/or services (“Agreement”).
I. Acceptance of Terms and Conditions

If the Customer places an order via WIFLY PHILIPPINES’s website (www.travelsrecommend.com), the successful online payment transaction shall constitute the Customer’s acceptance of theTerms and Conditions.
II. Authorization

If Customer is an entity other than an individual, the person signing the Agreement represents and warrants that he/she has been properly authorized and empowered to enter into the Agreement on behalf of such entity.

Customer authorizes WIFLY PHILIPPINES to verify the Customer’s creditworthiness with a credit reporting agency
III. Equipment Availability Options
Our Equipment is available byrental.Equipment Delivery/Return Option:

An order for Equipment must be placed by the Customer before 5 PM (Philippine Standard Time) Monday to Friday (no orders are processed on weekends) in order to be prepared for standard delivery options which include courier’s delivery to the designated address by Customer order or self-pick-up at WIFLY PHILIPPINES’s specified sales network, whichever way the Customer may choose in his/her discretion when placing order. If the Customer’s order for Equipment arrives after 5 PM, then the Equipment order will be considered to be placed on the next business day.

From the end of the Usage Term (Services period), the Customer has two (2) business days to return the Equipment to WIFLY PHILIPPINES. Late fees begin to accrue on the third (3rd) business day after the Usage Term ends as per the Standard Daily Rate of Customer order, per day/per unit, until the date Customer returns the Equipment, up to the equivalent of the Equipment being lost.

WIFLY PHILIPPINES will take responsibility for the Equipment during transportation to the Customer’s address as designated by the Customer.

Standard delivery dates are business days (non-holidays) Monday through Friday.

WIFLY PHILIPPINES will use reasonable efforts to deliver the Equipment prior to the date the Customer is scheduled to leave the country, but it shall not incur any liability in the event of any delay caused by force majeure or other circumstances beyond its control.

The Customer will accept the Equipment when delivered on or before the Departure Date, and if for any reason the Customer fails to accept the Equipment when delivered on or before such date, the Customer shall nevertheless be liable for the stated Services Charge and any applicable cancellation charge per the Terms & Conditions in which the Equipment was ordered.

If the Customer is not present when the Equipment is delivered to the Customer’s address, the Customer is authorizing WIFLY PHILIPPINES and its partner delivery company to drop off the Equipment at the Customer’s shipping address. From the time the equipment is delivered to the Customer’s address, the Customer is responsible for the care of the Equipment.
IV. Services Charges

Damages compensation under Equipment rental: WIFLY PHILIPPINES is entitled to bill the Customer, on a delayed basis, at any time after the Equipment has been returned for any and all damages for which the Customer shall be responsible pursuant hereto, whether or not WIFLY PHILIPPINES is aware of such damages at the time of the return of the Equipment. All damages compensations billed pursuant to this Agreement are payable by the Customer at the end of Usage Term.

In case of loss of device, Customer agrees to compensate WIFLY PHILIPPINESfor loss as follows:

If the Customer is having any difficulty with using the Service while at their destination, the Customer must notify WIFLY PHILIPPINES within the Services Period in order to qualify for any possible refund or discount to a Charge. Any refund or discount to a Charge is provided solely at WIFLY PHILIPPINES’s discretion.
V. Payment and Forms of Payment

The Services Charge is charged to customer credit card or by other payment methods acceptable to WIFLY PHILIPPINES upon placement of Customer order. Any other amounts due to WIFLY PHILIPPINES under this Agreement are payable at the end of the Usage Term.

By providing WIFLY PHILIPPINES with a Credit Card, the Customer represents that WIFLY PHILIPPINESis authorized to make charges on such account.
VI. Use of Equipment

Upon delivery to the Customer, WIFLY PHILIPPINES will provide instructions on the use of the Equipment by way of User Manual.

The Customer will use the Equipment in a careful and proper manner and in accordance with the instructions within the User Manual and in no other manner.

In the event the Equipment is stolen or lost, the Customer is liable for all Services Charges.

During the Use of Equipment, the Customer should contact WIFLY PHILIPPINES with any trouble or customer support issues in order to provide WIFLY PHILIPPINES the opportunity to resolve any difficulties.
VII. Equipment Malfunction Resolution

If the Equipment is not in working order when received by the Customer or subsequently malfunctions then the Customer will notify WIFLY PHILIPPINES immediately.

WIFLY PHILIPPINES will repair or replace the Equipment as soon as possible after WIFLY PHILIPPINES has been notified of the problem by the Customer, and provided the Customer is not in breach of its agreement with WIFLY PHILIPPINES, WIFLY PHILIPPINES will provide the Customer with the same or similar equipment as soon as possible for a period equivalent to the part of the Services Period unexpired when the malfunction occurred.

If WIFLY PHILIPPINES finds that Equipment reported as faulty is in working order then the Customer will pay the cost of collection and delivery of the replacement Equipment in addition to the other fees payable under the Terms and Conditions.
